The publisher of these Terms of Use is the Organizer – BUILDING HERITAGE LLC, based in Split at Žrnovnička 5, 21000 Split, Croatia, VAT ID: 62315787001, represented by the Director, Maja Borovina Frankić.
These Terms of Use govern the conditions and obligations of the Sponsors and Exhibitors, as well as the Organizer’s rights, in accordance with the specified terms, at the three-day event MBF – Masters of Building Fair, which will take place in Rovinj, Croatia, from October 10, 2024, to October 12, 2024.
These Terms (“Terms”) shall apply to any natural or legal person (exhibitors, sponsors, attendees, speakers, journalists, advertisers, service providers, etc.) (“Participants”) who request entry or are invited to the said event organized by the Organizer.
These Terms will also apply to other parties entering into an agreement with the Organizer.
If applicable, goods and services offered by Participants at the event (“Agreement”) will be available only to meet the requirements of natural or legal persons whose business activities are directly related to the sectors promoted by the Event, as defined in the participation agreement.
The Organizer reserves the right to refuse to enter into an agreement with any party whose business is not directly related to the sectors promoted by the Event or for any other reasonable cause, such as a dispute, etc.
In these Rules, the following terms shall have the meanings set forth below:

Agreement: Refers to these Terms and specific conditions and provisions, i.e., the participation agreement for the Event.
–
Event: Denotes the event organized by the Organizer.
–
Event Location: Means the venue where the Event takes place as specified in the participation agreement or elsewhere as decided by the Organizer.
–
Exhibitor: Any Participant who rents a booth or assigned exhibition space at the Event.
–
Attractions: Refers to the exhibitors’ attractions and/or mechanical, electrical devices that are displayed and can be tested during the Event, including but not limited to: boat rides, virtual reality experiences, and exhibition attractions.
–
Entertainment Content: Includes all additional activities related to the Event that are neither trade fairs nor conferences, such as ceremonial receptions, gala dinners, fly talks, boat rides, and similar events.
–
Dress Code: A set of rules that specify the clothing or type of attire and footwear to be worn by a group or individuals under certain circumstances, namely during the Event.
–
Marketing Materials: Promotional materials exclusively related to the participant’s company.
–
Exhibitor’s Technical Manual: A tool that assists in integrating exhibitors into the event. It is a collection of documents specifying the rules and regulations for exhibiting at the event. The technical manual will be provided to exhibitors no later than one month before the event begins.
ACCEPTANCE OF CONTRACT DOCUMENTS
Signing any participation agreement and/or any application for participation in the Event will be considered as the Participant’s full agreement with the terms of these Rules, relevant participation agreements, and specifications of the event venue operator.
Therefore, the Participant undertakes to comply with the agreed conditions, as well as all health protection measures prescribed by the competent public authorities and the Organizer, and to ensure that its employees and service providers act accordingly. No modifications to the contract may be made by the Participant in any way.
AMENDMENTS AND PRIORITY OF THESE RULES
The Organizer reserves the right to decide on all matters not covered by these Rules and to add new, immediately applicable provisions to cover such matters and all issues not otherwise governed by general regulations regulating commercial events, which are published on the website https://mbf.hr/. The Organizer will notify the Participants whenever necessary. These Rules take precedence over any other terms that Participants may attempt to impose or include, or which arise from trade, custom, practice, or the course of business. In case of a discrepancy between the Croatian version and any other translated version of this Agreement and all other regulations related to the event, the Croatian version takes precedence.
DRESS CODE
The dress code for the entire event is Business casual attire, which means men will wear suits and shirts, while women will wear trousers or skirts and shirts; or business dresses. The dress code for additional entertainment activities, such as a cocktail party, is business casual black & white attire, which means all of the above but in black and white colors.
The dress code for the gala dinner is black tie attire, implying that men wear formal suits with ties or bow ties, and women wear formal dresses.
CANCELLATION OF PARTICIPATION
The Organizer may cancel a participant’s participation in the event in the following cases:
– If an Exhibitor is not present at their Stand at least one (1) hour before the start of the Event or is not present at their stand at the start of the Event, for any reason. The Organizer may consider such failure as a cancellation of the exhibitor’s participation and be free to negotiate concerning the location of the stand, in which case the exhibitor will not have the right to a refund or compensation. In case of a delay by the Exhibitor, the Organizer has the right to charge for the entire day of delay, and the right to impose a contractual penalty of 0.5% per day of the total agreed price for each day of delay, up to a maximum of 10% (ten percent) of the contracted price, and to compensate the Organizer for any costs and damage that may arise. The Organizer has the right to a contractual penalty if the Contractor fails to fulfill any of its contractual obligations, is late in fulfilling them, or fulfills them improperly. The right to a contractual penalty does not diminish or exclude the Organizer’s right to compensation for any proven damage in excess of the amount of the contractual penalty.
– If the Participant attempts to cancel their reservation on any date for any reason;
– If, at the time of registration, the participant provides information that is false, inaccurate, or becomes inaccurate, resulting in their entry to the Event being denied.
This clause will not apply in the case of force majeure, which, if proven, gives the participant the right to a refund of the fee paid as defined in the above clause “Event Cancellation”.
– If at any time the stand remains empty, i.e., without a representative of the Exhibitor, penalties for abandoning the stand apply. Penalties amount to 100 euros/hour, calculated by the minute.
POSTPONEMENT, CANCELLATION, OR TERMINATION OF THE EVENT
- Postponement of the event
The Organizer may postpone the Event and is obliged to notify the Participants in a reasonable time beforehand, except in emergency situations, for 6 months after the period initially envisaged for the Event. In this case, the participant’s contract for participation will automatically and entirely be transferred to the new dates of the Event. The Organizer will retain the payments made by the participant.
- Cancellation of the event
The following conditions apply in the case of event cancellation. If the Organizer observes that the event cannot be held under the conditions predicted due to exceptional circumstances, whether they are cases of force majeure, especially if they are entirely unpredictable (“exceptional circumstances”), the Organizer may notify of the event’s cancellation.
Exceptional circumstances will include the following events: (fire, flood, storm, destruction or unavailability of the venue, accident, accidental case, strike at a local or national level, riots, security risk, terrorist threat, administrative ban or closure, health situation, potential consequences of the Covid-19 epidemic or other epidemics/pandemics, significant participation cancellation by a significant portion of participants, restriction of movement of participants or visitors, etc.
In these cases, the participant’s contract for participation will be cancelled, and the amounts paid to the organizer that are still available after direct costs incurred by the Organizer as of the date of notification of cancellation will be distributed among the participants, proportionally to the amounts paid by each of them.
Direct costs are defined as: costs and expenses – including all irrevocable VAT or any other equivalent sales tax – that can properly be attributed to the rental of the Space, management, promotion – including all advertising campaigns – and operation of the Event.
If the Organizer is forced to cancel the event upon noticing a significant change in the organization of the event that would be detrimental to both parties, such as an insufficient number of registrations, and unless such cancellation is the result of circumstances mentioned in the previous paragraph, the participant will be refunded the amounts paid to the Organizer.
- Termination of the event
In the case of a threat to public safety, the Organizer will determine whether to terminate or evacuate the event, and the participant waives the right to subsequently initiate proceedings against the Organizer.
In the case of modification, postponement, interruption, or cancellation of the event regardless of the circumstances or motivations, the participant may not seek any compensation from the organizer, except in the case of gross negligence by the Organizer.
ACTIVITIES
Sponsors may not conduct or schedule any external activities without the written permission of the Organizer, which conflict with the official program of the event, regardless of whether these activities take place at the event venue or outside it.
Fair participants may access additional entertainment content if they possess the corresponding registration fee.
ADMISSION REQUIREMENTS
Individuals under the age of 18 are not allowed to be admitted to the event, except with prior written approval from the Organizer.
The Organizer reserves the right to deny entry or to temporarily or permanently remove any participant whose presence, behavior, or conduct threatens the peace or security of the event and/or other participants and/or the Organizer and/or the integrity of the venue.
To gain access to the event, participants must show a pass which the Organizer will issue for free or for a fee according to its own procedures. The distribution, reproduction, or sale of passes with the intent for someone other than the participant to profit from them is strictly prohibited and may be subject to legal action.
Given the international nature of the event, participants must:
– Ensure that their participation is neutral in political, ideological, or religious beliefs;
– Not create noise (visual, sound, olfactory, or of any other nature) that disturbs the organization of the event, other participants, whether in neighboring stands or not, or the public, either at their stand or in the advertising space allocated within the event. Otherwise, the Organizer reserves the right to impose penalties, including denial of entry to the event.
PARTICIPANT ACCREDITATION
Participants may accredit only their permanent employees. The Organizer may at any time request proof regarding this. If a participant accredits any person who does not meet the above requirements, they will be required to pay the visitor participation fee as stated in the participation agreement.
The Organizer sets the rules for issuing and using official accreditations and informs the Participants about them. The official pass is issued in the name of the person accredited by the exhibitor and is its only authorized user. In case of misuse, the organizer may revoke the issued official pass, and the person who misused it will be permanently removed from the event.
Entry is permitted only to persons with accreditation.
ADVERTISING
The Organizer retains the exclusive right to place advertisements and other marketing materials and conduct promotions at the event venue and in its immediate surroundings. In case of non-compliance with these requirements, the Organizer may at any time, without prior notice, remove such advertising. Participants may not display products or services or advertise companies or businesses that are not participants, without prior written approval from the Organizer. Furthermore, the distribution of flyers, brochures, or any type of documents for promotional or other purposes is strictly limited within the event space and its immediate surroundings and is subject to prior approval from the Organizer. Participants must not advertise any person or entity that is a member of a regulated profession for which the national and official organization representing the profession prohibits advertising.
SPONSORSHIP
Some of the Organizer’s events may be sponsored by participants according to the terms and conditions set out in the relevant participation agreement that defines the characteristics of the event. Unless otherwise specified, such sponsorships are not exclusive. If more than one participant sponsors the same event, the Organizer will promote the participants proportionally to their respective contributions. The Organizer reserves the right, at its discretion, to modify the characteristics of the event or request participants to modify materials intended for distribution, particularly due to legal requirements and/or for reasons of general organization of the Event and/or, in general, in the interest of all participants. The Organizer will make every effort to notify participants in advance, except in cases of urgent needs that exempt the Organizer from doing so.
PHOTOGRAPHY AND RECORDING (AUDIO AND VIDEO)
During the event, the Organizer is authorized to freely take photographs and produce other types of video and audio recordings in the provided exhibition spaces and use them for its own and general purposes. Participants, in this respect, waive any copyright and claims, and they have the authority for such recordings without special permission from the Organizer, except within their own exhibition space. The participant is authorized to make their promotional material available to visitors only within the space they have leased.
The Organizer may prohibit the taking of photographs and/or making of audio and video recordings by participants who have not received accreditation from the Organizer for this purpose. Only photographers/videographers who have received written authorization from the Organizer for this purpose may work within the Event space. A copy of their photographs and/or audio and video recordings will be provided to the Organizer upon request.
Participants hereby authorize and give consent to the Organizer and its partners to photograph and/or record the voice and image of participants, stands, or certain objects displayed within the stands, distribute the said photographs and/or records to third parties, and communicate them to the public, worldwide, which may be displayed (especially in the form of live or delayed broadcasting), reproduced without limitation in the number of reproductions, and published, worldwide, for a period of five (5) years, in any format, using any known or unknown method or process at that time, in whole or in part, on all material or immaterial media known or unknown at that time, including, in particular, the internet (websites of the Organizer and its partners and social networks) and on any other promotional or marketing tool that may be used for informational or promotional purposes.
UNFAIR BUSINESS PRACTICES
Participants commit not to engage in activities that are identical or similar to those conducted at the Event venue (specifically attending meetings with professionals who are not registered at the Event), in the immediate vicinity, or any other Event Location that the Organizer may designate, especially in places like hotels or other external locations during the duration of the Event. Participants are obliged not to directly or indirectly entice other participants from any Event Location to present their products and/or services that are within the scope of the Event.
ACCOMMODATION AND TRAVEL
The Organizer may enter into agreements with hotels and travel agencies to assist participants as much as possible and under the best possible conditions in finding accommodation or travel. However, this does not constitute an endorsement by the Organizer of any particular accommodation/travel provider nor an obligation on the part of the Organizer, and the Organizer will not be responsible for travel, hotel bookings, and/or selected accommodations.
ALLOCATION AND DISTRIBUTION OF LOCATIONS
The method of determining the allocation of stands will be established by the Organizer and may change from time to time, with notification, called “stand change confirmation,” to the exhibitor. The Organizer will consider the exhibitor’s requests, the type of products and services they plan to exhibit, and the layout of stands and/or allocated locations they plan to set up in accordance with the interests of the Event. All layout plans available to the exhibitor are for illustrative purposes only and do not guarantee that a particular exhibitor will be placed next to or near any other exhibitor. However, the Organizer will make reasonable efforts to accommodate the exhibitor’s requests concerning these matters.
The Organizer will not be responsible for any consequences that may arise from the assigned location, such as low visitor frequency.
In the event that a participant/exhibitor causes disruption or fails to comply with the requirements of the Exhibitor’s Technical Manual, the Organizer reserves the right to change, at any time and as many times as deemed necessary, the use of the assigned location requested by the exhibitors, the location of stands, or their decoration.
STAND LOCATION, SETUP, ASSEMBLY, DECORATION, AND DISMANTLING
- Setup, assembly, and management of the stand and/or allocated location
In accordance with the Agreement, if the Event includes stand services and the participant is an exhibitor, the following applies:
Exhibitors are obliged to familiarize themselves with the Exhibitor’s Technical Manual and the specifications of the exhibition space in effect and to adhere to them, comply with safety measures prescribed by applicable laws and regulations throughout the Event.
- Code of conduct
Exhibitors are required to be present at their stand and/or allocated location, as well as during inspections by persons responsible for implementing safety standards. Under the contractual terms, the prevention plan in case of an accident or damaging event, and in accordance with the overall decoration of the Event,
- Decoration
Exhibitors cannot freely decorate their stand. They may order decoration services from the Organizer’s additional services price list or submit a written request for approval to set up their own decorations at the stand, which the Event Organizer will approve or deny in writing.
The Organizer reserves the right, at any time and at the exhibitor’s expense, to prohibit the use of the stand and/or allocated location, suspend the use of water and electricity, or remove or destroy any material or installation deemed non-compliant.
The Exhibitor is fully acquainted with the specifics of the stand as described in the participation contract. If the Exhibitor of the stand does not dispute the compliance of the Stand from its receipt, it is considered that the latter has accepted it.
- Promotional materials
The Exhibitor may not bring any materials or installations that are not included in the range of the selected stand. If they do, the Exhibitor will compensate for the damage and release the Organizer from liability in case of any damage caused by the installations and/or added material.
- Security of the stand and/or allocated location
Exhibitors must always maintain sufficient staff at their stand and/or allocated location and fully equip it throughout the duration of the Event, including any extension of the Event. Exhibitors must display products and/or services that comply with laws and regulations and originate from lawful activities, and must obtain all necessary permits to conduct their business at the Event. Products and/or services may only be displayed within the stand, must not encroach on aisles, and in no way obstruct neighboring exhibitors or any other participant, staff, or representative of the Organizer or Event operator. Materials, products, and/or services must be arranged aesthetically. Off-premises sales or sales in which goods are immediately delivered to the buyer are prohibited, except with prior written authorization from the Organizer. Events held at the stand and/or allocated location, such as attractions, performances, events, etc., require prior authorization from the Organizer.
DELIVERY OF MARKETING MATERIALS
The participant is obliged to deliver promotional materials to the event location on the opening day, October 10, 2024, by 8:00 a.m. The participant must remove all promotional materials by October 12 from 2:00 p.m. to 3:00 p.m.
CLEANING OF EXHIBITION SPACES
The Organizer takes responsibility for cleaning the aisles, entrances, and other common areas used by all exhibitors and visitors. The cleaning of stands and exhibits is the exclusive responsibility of the Sponsor – Exhibitor, who must clean the sales area and surrounding space and dispose of waste in containers each day after the event concludes. Based on a written order, the Organizer may provide stand cleaning services for which it will issue an invoice, charging for the entire area of the stand. The Organizer will provide a price list for stand cleaning services upon request from the Sponsor/Exhibitor. All exhibition spaces must be clean and orderly during the event’s operating hours; otherwise, the Organizer will perform the cleaning and issue an invoice to the space user.
DAMAGE AND REPAIRS
Participants will be responsible for any damage they cause to the Event venue. In particular, exhibitors must leave their Stand, as well as all equipment and materials provided by the Organizer, in their original condition at the time of taking over their Stand. Therefore, upon taking over their Stand, exhibitors must document any existing damage and send this evidence by email to the Organizer’s technical department on the same day. Otherwise, exhibitors risk being invoiced for such damage.
Exhibitors must vacate their stand and remove their goods, items, and special decorations, as well as any remaining waste from materials used for decorating the stand, within the period and during the hours determined by the Organizer, respecting local laws, regulations, and practices regarding waste. Failure to meet these deadlines will make the exhibitor liable for all costs incurred due to non-compliance with these instructions, as well as for any damage caused by the exhibitor.
Exhibitors demonstrating and/or offering attractions to participants are responsible for complying with all local laws and regulations governing the operation of rides and for securing all necessary permits for demonstrating and offering rides during the Event.
Exhibitors are responsible for any damage caused by them or their employees to the venue and/or any Event participant. Participants who wish to try out the attractions offered by exhibitors understand and accept the risks and release the Organizer from any claims.
ALLOCATION AND SUBLETTING OF ASSIGNED LOCATIONS
Exhibitors are expressly prohibited from assigning, subletting, or exchanging, whether free of charge or for a fee, the whole or parts of locations allocated by the Organizer, including stands and advertising spaces. However, multiple exhibitors may be allowed to exhibit together provided they have submitted a request to the Organizer and received approval.
PRICE AND PAYMENT PROCEDURES
Fees and costs paid by the participant, as well as the procedures and deadlines for payment, are unilaterally determined by the Organizer in the participation contract, which the participant expressly accepts. Depending on the date of signing the participation contract, the payment will be equal to the amounts that have already fallen due on the relevant date. Participants will not be granted any discount for payment before the due date. Payments must be made by the participant in net amounts. VAT is not included in the price.
An additional invoice will be issued for any service that participants may order, which is not listed in the relevant participation contract.
DELAY OR NON-PAYMENT
In the case of payment delay, the participant will be responsible for compensation for the delay along with statutory late interest, calculated at the statutory interest rate, starting from the date specified as the payment date in the participation contract and on the invoice. This provision is not considered an extension of the payment deadline. Incomplete payment of the price will prevent the participant from registering for any future event of the Organizer.
INTELLECTUAL PROPERTY
The participant guarantees to the Organizer that they or their licensors own all intellectual property rights to the content defined below and in the exhibited materials, or possess the necessary authorizations for displaying and/or distributing them in connection with the Event. To ensure complete transparency of the event, at the request of the Organizer, the participant will provide all catalogs and/or brochures, or media containing them, related to the products and rights offered. The participant will inform the Organizer in writing if they plan to broadcast music at their stand and/or allocated location and/or in their advertising space, and will submit all necessary reports and/or to other relevant regulatory bodies and make the corresponding payments. The participant will indemnify and hold the Organizer harmless in case of any claims based on non-compliance with these obligations contained in this clause.
By signing the participation contract, the participant grants the Organizer, from the date of signing the participation contract, for the duration of the Contract, and for a period of 5 (five) years after the expiration of the said contract, the right to use their business name, trade name, and/or trademark(s) or any other element or intangible right (“Trademarks”) for the purpose of promoting the Organizer’s events (especially through reproduction on the event websites and social media and their broadcasting by any means).
The participant guarantees to the Organizer that they are authorized to freely dispose of their Trademarks (and/or any other element or intangible right) and guarantees the Organizer complete, free use and possession of the Trademarks.
MEDIA AND ORGANIZER MATERIALS
During the Event, the Organizer will provide participants with printed materials, a website, a networking and event management application, and all other materials specific to the Event (“Organizer’s Media” or “Media”). The Organizer owns and publishes all Media that it issues and distributes. The Media cannot be used by the participant in any way without prior written approval from the Organizer.
– Participants agree that all texts, videos, images, databases, trademarks, data, IT applications, and/or functionalities published in the Organizer’s Media, except those provided by participants (“Materials”), are the property of the Organizer and/or third parties. Participants may not reproduce, modify, delete, distribute, assign, and/or use the content, in whole or in part, in any way, without the prior written approval of the Organizer, its licensors, and/or relevant rights holders.
– Participants grant, without compensation, the Organizer the right to reproduce and use their own content, distribute the Organizer’s Media. The participant is solely responsible for the information and documents provided, which are published and distributed through the Organizer’s Media. The Organizer will not be liable, even in case of error and/or omission in publishing and/or distribution of the media, especially if caused by incorrect or incomplete information provided by the participant. Furthermore, each participant must possess all necessary authorizations, and the information and documents they possess must not contain insults, defamation, hate speech, calls to violence, indecency, blasphemy, or any other unlawful behavior.
Participants must avoid offensive, racist, or sexist remarks and behave ethically, and graphic materials must reflect high business ethics and not be of an indecent nature.
– Regarding advertising on the Organizer’s Media, the Organizer will determine the available advertising spaces on its Media and has the right to control all advertising material distributed on them to ensure compliance with applicable laws and protect the interests of the Event and/or participants. The Organizer may delete any statements that directly or indirectly provide false information or promote illegal activities, services, or products, as well as any illegal statement or image. Each approved type of advertisement within the Event’s venue must bear the label “ADVERTISEMENT”. The Organizer may refuse to publish controversial text or advertisement, in which case the participant will be refunded the amount paid for the advertising space. If a participant orders advertising on the Organizer’s Media but fails to provide the Organizer with the necessary information and documents for publication on time, the Organizer reserves the right to arrange advertising with another participant on the Organizer’s Media. In this case, the participant has no right to a refund of the price of their order or any compensation. Documents used for advertising publication will be returned to the participant or their representative only upon request. The Organizer is obligated to keep such documents for only one (1) year and may destroy them after that period.
NETWORKING AND EVENT MANAGEMENT APPLICATION
To facilitate organizing business meetings between participants, the Organizer may contract with a provider for a networking and event management application. To facilitate participant registration, enable them to prepare for the event, and plan business meetings during the event, the Organizer may pre-populate the application on behalf of the participant with their personal data that the Organizer possesses through the participation contract. Once connected, the participant is personally responsible for completing their own entry in the application to benefit from the online tool’s features. The processing of these data is governed by the “Privacy and Data Rules” clause below. The Organizer disclaims all responsibility if participants do not receive incoming messages or meeting requests from other participants. The use of the application by participants will be under their sole responsibility and must comply with the application’s terms.
PRIVACY AND DATA RULES
The Organizer collects personal data of participants through this document, networking and event management applications, or during participation in the event (visited locations or events, provided services) in accordance with the following provisions and Privacy Policy.
Data Protection – In line with the new European General Data Protection Regulation (GDPR) effective from May 25, 2018, the Organizer guarantees to Event participants that their personal data will be used exclusively for fulfilling requests, concluding and executing contracts, for marketing, and other legitimate interests important for business operations. The Organizer will use participants’ personal data for clearly defined purposes and will not disclose them to third parties or use them for undefined purposes.
Personal data processing of participants will be carried out in compliance with the GDPR and applicable Croatian laws and regulations.
Personal data refers to information related to identifiable participants, such as names, email addresses, telephone numbers, and addresses.
Providing personal data for access is considered your consent to process your personal data.
Your Rights
As a data subject whose data is processed by the Organizer in the context of visiting and using the website https://mbf.hr/, all participants have the following rights:
The right to information (Article 15 of the GDPR): You have the right to request information about the data we process and how we use your personal data. Additionally, you have the right to obtain more information about the specifics of processing purposes, the categories of processed data, the recipients or categories of recipients of data, the data storage duration, the right to deletion or correction of personal data, the right to lodge a complaint, and the origin of the data.
The right to rectification (Article 16 of the GDPR): You have the right to request immediate correction of your personal data if it is incorrect, invalid, or incomplete.
The right to erasure (Article 17 of the GDPR): You have the right to request the deletion of your personal data.
The right to restrict processing (Article 18 of the GDPR): Under the limited circumstances set out in Article 18 of the GDPR, you have the right to restrict the processing of your data, meaning we can store but not further process your data.
The right to data portability (Article 20 of the GDPR): You have the right to request data related to you that you have provided to us in a structured, commonly used, and machine-readable format; you can send these data to other services or have them forwarded.
The right to object (Article 21 of the GDPR): You have the right to object at any time to how we process your data in the context of the website https://mbf.hr/
The right to withdraw consent (Article 7 of the GDPR): You have the right to withdraw your consent to data processing when data processing is based on your consent.

To exercise these rights in accordance with data protection regulations, all participants can contact the Organizer, or the data protection officer, via email: mbf@building.hr.
Data are processed by the Organizer for the purpose of fulfilling its contractual obligations (especially managing the customer database, accessing the online participant database, managing events, services and ticketing, invoicing, and payment management) and promoting its activities.
Such data are stored for a maximum of 10 years, except for the online participant database where data are stored for a maximum of 3 years.
These personal data may be:
integrated into an online database accessible to participants to facilitate event preparation, networking, business promotion, and planning of business meetings. In this regard, participants commit to not using the data for other purposes. Participants who use the data contained in the database for their own purposes are considered data controllers and bear all obligations of this status towards other participants. The Organizer will not be liable under any circumstances for unlawful data processing and use by other participants or third parties;
transferred to entrepreneurs committed to respecting data protection laws, such as companies within the same group, service providers, and partners who may be located outside the European Economic Area;
transferred to the Organizer’s partners, who may become data controllers, for organizing events or sessions, or for publishing videos that participant data subjects will attend and/or view online;
communicated to third parties for conducting commercial surveys on their behalf as data controllers;
used across all distribution and promotional media related to the relevant event, including but not limited to, internet media; processed for the purpose of distribution and promotion analysis (profiling, targeting).
As a data controller, the Organizer has implemented and maintains appropriate technical and organizational measures to ensure that the processing of personal data complies with data protection laws, specifically the General Data Protection Regulation (GDPR). Participants have the right to access, retrieve, rectify, and restrict the use of their personal data, to the extent that the data is processed exclusively by the Organizer. Within the framework of the Contract, the Exhibitor may process, collect, or access participant data. Therefore, both Parties (Exhibitor and Organizer) commit to strictly adhere to the General Data Protection Regulation as data controllers, and they will specifically inform the data subjects whose data are being processed and protect the data.
COMPLIANCE WITH LAWS
The Organizer, along with participants, must adhere to all applicable laws, regulations, and economic sanctions relevant to their obligations and the execution of this contractual obligation throughout the duration of the Contract, including:
– Economic and trade sanctions and controls, and applicable anti-corruption laws and related legislation.
To fulfill this obligation, both parties will not conduct transactions on behalf of the other party, nor cause the other party to perform transactions, directly or indirectly, with any person subject to applicable economic sanctions or with whom transactions are otherwise prohibited.
ELECTRONIC SIGNATURE
Parties acknowledge that if signed electronically, this Contract constitutes an original document that is permissible as evidence and fully valid.
INSURANCE
Participants must obtain all necessary insurance policies for their participation in the Event. The Organizer disclaims all responsibility in this regard, especially for the loss or theft of personal property.
The Organizer will not be liable for any claims for which exhibitors may be responsible or any loss that exhibitors may suffer due to insufficient insurance. The exhibitor agrees that neither the Organizer nor the event venue operator will be liable for any claims made by third parties in relation to the attractions. The exhibitor agrees to indemnify and compensate the Organizer and the event venue operator for any claims, including third-party copyright infringement claims.
The Organizer is not responsible for any form of damage or loss to the property and equipment owned or rented by the Sponsor/Exhibitor, caused by negligence, loss, theft, fire, etc., within the event venue. The Sponsor/Exhibitor must pay special attention to equipment or other exhibits requiring such attention due to being easily flammable or otherwise hazardous, and if damage to the Organizer occurs due to these or any other fault of the Sponsor/Exhibitor, the Sponsor/Exhibitor is obligated to compensate according to the invoice issued by the Organizer.
LIMITATION OF ORGANIZER’S LIABILITY
The Organizer commits to perform all services listed in the participation contract according to professional standards and practices and applicable regulations, except in cases of force majeure.
The Organizer will only be liable for direct damage suffered by the Participant, for which the Organizer is responsible, without joint and several liability towards third parties contributing to the damage.
Each Participant assumes responsibility for compliance with all relevant regulations, laws, and national, regional, and local legal provisions concerning fire, safety, and health.
The Organizer will not be liable for any direct or indirect damage, including, but not limited to, loss of profits, reputation, data, resulting from the use or inability to use the Event’s website, unauthorized access or alteration of your transmissions or data; statements or behavior of you, other participants, and/or third parties in accessing or using the services;
The Organizer does not guarantee uninterrupted operation or that information will be error-free and does not make any representations or warranties regarding the content of the website, particularly concerning data transmitted directly or indirectly by participants.
The Organizer is not liable for any failure or delay due to circumstances beyond its control.
LEGAL SANCTIONS AND CONTRACTUAL PENALTY
In case the Participant fails to fulfill its obligations under the Contractual documents, after having been duly warned in writing by the Organizer, the Organizer reserves the right to take the following actions:
Unilaterally and automatically terminate the participation contract;
Order the immediate closure, followed by the removal of the stand and/or allocated location and/or the immediate expulsion of the Participant from the event venue;
Prohibit the Participant from participating in the Event for two (2) consecutive full years;
Suspend access to the networking and event management application at any time;
Enforce the right to contractual penalties and damages in accordance with legal regulations.
These sanctions can be applied without prejudice to legal proceedings that the Organizer may initiate to assert its rights and seek compensation for damages due to the Participant’s breach of the relevant business conditions and obligations under the Contract.
The Participant will be responsible for costs associated with actions the Organizer may have to undertake to enforce the provisions of these Rules and/or Contractual documents against the Participant (enforcement costs, costs associated with the removal of the stand, etc.).
In case of delay by the Exhibitor, the Organizer has the right to charge for the entire day of delay, and the right to impose a contractual penalty of 0.5% per day of the total contracted price for each day of delay, up to a maximum of 10% (ten percent) of the contract price, and to compensate the Organizer for any resultant costs and damage.
The Organizer has the right to a contractual penalty if the Contractor fails to fulfill any of its contractual obligations, is late in fulfilling them, or fulfills them improperly. The right to a contractual penalty does not diminish or exclude the Organizer’s right to compensation for any proven damage beyond the amount of the contractual penalty.
VALIDITY
Should any provision of these Rules be deemed void or unenforceable, such provision will be severed from the contract without affecting the validity of the remaining provisions.
APPLICABLE LAW AND JURISDICTION
In case of disputes arising from or related to this Contract, including issues concerning its valid formation, breach, or termination, as well as the legal effects arising therefrom, the Contracting parties will seek amicable resolution. In the event that dispute resolution is not possible, the contracting parties agree to the jurisdiction of the competent court in Split.
